Terms & Condition

TERMS AND CONDITIONS
These Terms and Conditions ("Terms") constitute a legally binding agreement between API MOTORS LTD, registered in England and Wales, whose registered address is 5 Challenge Way, CO1 2LY, Colchester, Essex ("we", "us", "our") and the customer ("you", "your").

These Terms apply to all goods and services supplied by us, including MOT testing, vehicle servicing, repairs, diagnostics, and related automotive services. By instructing us to carry out work or by using our services, you agree to be bound by these Terms.


1. Services Provided
We provide MOT testing (including Class IV and Class VII), vehicle maintenance, repairs, diagnostics, and related automotive services from our premises in Colchester, Essex.


2. Prices and Labour Rates
2.1 All prices are quoted in pounds sterling (£) and are exclusive of VAT unless stated otherwise.

2.2 Our standard labour rate is £80.00 per hour plus VAT, effective from 1 January 2026.

2.3 MOT fees are charged in accordance with DVSA regulations.

2.4 MOT retest fee: From 1 January 2026, a MOT retest fee of £10.00 (VAT free) applies to Class IV and Class VII vehicles, where applicable under DVSA rules.

2.5 Prices may be displayed on our premises, provided verbally, or confirmed in writing. Any estimates provided are non-binding unless expressly agreed in writing.

2.6 We reserve the right to adjust prices. Any changes to pricing for ongoing work will be communicated to you in advance.


3. Payment Terms
3.1 Payment is due in full upon completion of the work or collection of the vehicle, unless otherwise agreed in writing.

3.2 Accepted payment methods include cash, debit card, credit card, or any other method we make available.

3.3 We reserve the right to retain possession of the vehicle under a mechanic’s lien until full payment has been received.


4. Late Payment and Storage Charges
4.1 Invoices not paid within 30 working days from the invoice date will be considered overdue.

4.2 Where a vehicle remains on our premises or in designated areas for more than 14 working days after notification that work has been completed or payment is due, a late payment / administration charge of £100.00 plus VAT will apply.

4.3 We reserve the right to charge reasonable storage fees where vehicles are left uncollected for extended periods, following reasonable notice.

4.4 We may instruct a third-party debt recovery agency to recover overdue sums, and you will be responsible for reasonable recovery costs permitted by law.


5. Vehicle Delivery and Collection
5.1 You are responsible for delivering and collecting your vehicle from our premises.

5.2 Vehicles left with us are held at your risk, subject to Clause 6.

5.3 You confirm that the vehicle is adequately insured while in our possession.


6. Liability
6.1 Nothing in these Terms limits or excludes our liability for:

Death or personal injury caused by our negligence;
Fraud or fraudulent misrepresentation;
Any liability that cannot be excluded or limited under UK law.
6.2 Subject to clause 6.1, we are not responsible for loss or damage to the vehicle or its contents unless caused by our negligence.

6.3 Where we are found liable for loss or damage (other than matters listed in clause 6.1), our liability shall be limited to the reasonable cost of the service provided.


7. Cancellations
7.1 Bookings may be cancelled by giving reasonable notice.

7.2 We reserve the right to charge for work already completed or parts ordered prior to cancellation.


8. Data Protection
8.1 We process personal data in accordance with the UK GDPR and Data Protection Act 2018.

8.2 Full details of how we use your data are available in our Privacy Policy.


9. Customer Responsibilities and Indemnity
9.1 You confirm that you are authorised to instruct work on the vehicle.

9.2 You agree to indemnify us for any loss or damage caused by inaccurate information provided by you or by hazards not disclosed prior to work commencing.


10. Intellectual Property and Confidentiality
All intellectual property associated with our business remains our property. Any confidential information shared during the provision of services will be treated in confidence.


11. Complaints and Disputes
11.1 We encourage customers to raise complaints directly with us in the first instance.

11.2 These Terms are governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.


12. Changes to These Terms
We may update these Terms from time to time. The latest version will be available on request or displayed at our premises. Continued use of our services constitutes acceptance of the updated Terms.
